| Abstract: | This thesis is aimed to define when the presence of all coparties is required at a proceeding of “regolamento di competenza”, only filed by or against a few of them . This issue cannot be resolved as a mere problem of coordination between par. 47 and the system of par. 331-332 c.p.c., but opens an interesting perspective on the wider subject, concerning the static configuration and the dynamic treatment of competence questions within objectively and subjectively complex proceedings.
The survey points out two remarks:
1) in case of joinder of actions, the respective competence questions are not unrelated, but, according to and within the limits of the rules dictated by par. 31 and following c.p.c., they match – if necessary, modified – into logic relations of identity or attraction (synthetically defined “meta-questions”), in order to converge on the individuation of a sole judge.
